Every year thousands of people are arrested for one reason or another. It would be wrong to think that it is only hardened criminals that fall foul of the law. Many ordinary people make mistakes. They drink and drive, they ignore a court order and sometimes they are just at the wrong place at the wrong time. The justice system is struggling to stay abreast of all the cases that demand attention. It is simply not feasible to keep all accused people locked up until they can be brought in from of a judge. They provide instant loans to people that must pay bail. The accused will have to sign a contract and undertake to pay a fee that can be up to a tenth of the loan amount. Bondsmen are active near or at almost every court building.


Accused are released on strict conditions. If the break these conditions they can be arrested and charged anew and this time round they are not likely to be given bail. The same holds true for honoring the agreement with the bondsman. Failure to pay will lead to all the assets of the accused being attached and sold to cover the amount of the loan.


Detractors of the system say that it is wrong to allow arrested people to go free because they will simply commit crime again. This is, in fact, not the case. Most accused people need to be able to look after their families and maintain their jobs. They pitch up for their cases and they do not pose a threat to society.


It must also be kept in mind that a large percentage of cases are thrown out of court because of lack of evidence and it is not fair to detain the accused indefinitely. Many others are found to be innocent or they are convicted of minor offences that simply do not justify detention. Innocence is presumed and there are excellent reasons for this approach.


Bondsmen are often criticized for their high fees but many accused have no other way to pay their bail. The alternative is ghastly. It would then be necessary to stay incarcerated until family and friends are able to gather enough cash to secure the release of the accused. This may take days or even weeks.
